Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of the Fireguy|Repeater Planner website and application (the “Service”), operated by Fireguy.NET (“we,” “our,” or “us”). By creating an account, signing in, accessing, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

The Service is part of the Fireguy.NET network and is provided primarily as a planning and field-operations aid for wildland fire and related emergency communications. It is not an official government system and is not affiliated with NIFC, NWCG, FEMA, or any specific agency unless expressly stated.

1. Eligibility and authority

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Service. By using the Service you represent that you meet this requirement and have legal capacity to enter a binding agreement.

If you use the Service on behalf of an agency, department, organization, or other entity, you represent that you have authority to bind that entity to these Terms, and “you” includes that entity.

2. Accounts and security

Certain features require registration. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must notify us promptly at repeater@fireguy.net of any unauthorized use of your account or security incident you become aware of. We may require email verification before sign-in and may suspend accounts we reasonably believe are compromised or abused.

You may not share login credentials in a way that circumvents access controls, invite policies, or permission groups. Incident owners and editors remain responsible for whom they invite and what roles they grant.

3. Description of the Service

The Service may include, without limitation:

• Incident workspaces for radio-system planning and field ops;
• Map-based terrain-aware coverage, link, route, placement, and point-check analysis;
• Inventory, batteries, frequencies (including ICS-205-style channel plans), roster, shifts, phone lists, radio logs, line orders, waybills, diagrams, and related exports;
• Optional integrations (for example ZoneMap publication, GroupMe / Slack / Discord / other notification channels) that you configure;
• Account profile data, including optional qualifications and emergency contacts;
• Sharing and collaboration features within incidents you create or join.

Features change over time. We may add, modify, suspend, or discontinue any part of the Service, including while the product remains under active development.

4. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Violate applicable laws or regulations (including radio spectrum, export, privacy, and workplace rules that apply to you);
• Infringe intellectual property, privacy, publicity, or other rights of any person;
• Upload or transmit malware, or attempt unauthorized access to the Service, other accounts, or our systems;
• Use automated scraping, bulk harvesting, or denial-of-service techniques except as we expressly permit;
• Interfere with integrity, performance, or security of the Service;
• Harass, defame, or harm others, or store content you are not authorized to process;
• Misrepresent analysis results, exports, or published channel plans as certified, guaranteed, or agency-approved when they are not;
• Resell, sublicense, or commercially exploit the Service without our prior written consent;
• Use the Service to plan or facilitate unlawful interference with communications systems.

We may suspend or terminate access if we reasonably believe you have violated these Terms or applicable law, or if continued use poses risk to the Service or others.

5. Your content and operational data

You retain ownership of content and data you submit or create in the Service (“Your Content”), including incident names, sites, coverage artifacts, channel plans, roster and contact information, logs, and uploads.

You grant us a limited, non-exclusive, royalty-free license to host, store, process, transmit, display, and back up Your Content solely as needed to operate and provide the Service to you and to collaborators you authorize (including optional third-party integrations you enable).

You are solely responsible for Your Content, for obtaining any consents required to include personal or sensitive information about others (for example roster members, emergency contacts, or phone numbers), and for complying with your agency’s records, PII, and operational-security policies. When you invite others, publish to ZoneMap, share join links, or enable notification integrations, you understand that authorized recipients and those third-party services may receive related information according to the features you use and their own terms.

6. Our intellectual property

The Service—including software, design, text, graphics, logos, and trademarks—is owned by Fireguy.NET or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, reverse engineer (except to the limited extent allowed by law), or create derivative works of the Service except as necessary for ordinary use.

“Fireguy|Repeater Planner,” “Fireguy.NET,” and related marks are used in connection with operating this Service. Third-party names (for example ZoneMap, map data providers, or messaging platforms) remain the property of their owners.

7. Planning tool disclaimer — read carefully

The Service is a planning and decision-support tool, not a guarantee of radio performance, safety, or mission success. Coverage maps, link budgets, point checks, placement suggestions, and related outputs are estimates based on models, elevation and land-cover data, antenna and receiver assumptions, and user-entered parameters. Real-world results can differ materially due to foliage, temporary infrastructure, ducting, buildings, equipment condition, operator technique, frequency coordination, and many other factors.

You must field-verify critical paths before relying on them for life safety, aviation, tactical, or other operational decisions. Do not treat a favorable model result as authorization to omit standard communications planning, ICS processes, or agency SOPs. Outputs are not legal, engineering, or regulatory certifications.

Map tiles, elevation, land cover, fire perimeter, and building datasets may come from third parties and may be incomplete, outdated, or inaccurate. Attribution for basemaps and data layers is shown in the product where applicable; those providers’ terms also apply to their data.

8. Not an emergency service

The Service is not a substitute for 911, dispatch, official ICS forms systems, or agency command-and-control networks. Do not rely on the Service as your sole means of emergency notification. Optional IWI / messaging integrations depend on third-party networks and configuration you control; delivery is not guaranteed.

9. Third-party services and links

The Service may link to or integrate with third-party sites and services (including analytics, email delivery, ZoneMap, GroupMe, Slack, Discord, Courier or similar notification providers, OCR, and map/data sources). We do not control and are not responsible for third-party content, availability, security, or privacy practices. Your use of those services is subject to their terms and policies. Enabling an integration constitutes your instruction to share the data required for that feature.

10. Fees

The Service is currently offered without a subscription fee for ordinary use. We may introduce paid features or change pricing in the future with notice posted on the Service or sent to your account email. If paid features are offered, additional payment terms will apply. Unless stated otherwise, any fees are non-refundable to the maximum extent permitted by law.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT RESULTS WILL MEET YOUR REQUIREMENTS OR MATCH FIELD CONDITIONS.

Some jurisdictions do not allow certain warranty exclusions; in those jurisdictions, exclusions apply to the fullest extent permitted.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIREGUY.NET AND ITS OPERATORS, AFFILIATES, LICENSORS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR OPERATIONAL OUTCOMES, MISSED COMMUNICATIONS, EQUIPMENT ORDERS, PERSONNEL MOVEMENTS, OR SAFETY INCIDENTS THAT YOU OR OTHERS ATTRIBUTE TO RELIANCE ON THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Fireguy.NET and its operators, affiliates, and licensors from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your invitations, publications, or integrations; (d) your violation of these Terms or law; or (e) your violation of any third party’s rights.

14. Suspension and termination

You may stop using the Service at any time. To close your account and request deletion of associated personal data, contact repeater@fireguy.net (see the Privacy Policy for details and limitations regarding shared incident data).

We may suspend or terminate access at any time, with or without cause or notice, including for violation of these Terms, prolonged inactivity where we provide prior notice, security risk, or discontinuation of the Service. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (including Sections 5–13 and this survival sentence) survive termination.

15. Changes to the Service and Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Material changes may also be communicated through the Service or by email when appropriate. Continued use after the effective date constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and request account closure.

16. General

Governing law. These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law principles.

Venue. Except where prohibited, you agree that courts located in California shall have exclusive jurisdiction over disputes arising from these Terms or the Service.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Fireguy.NET regarding the Service and supersede prior agreements on that subject.

Severability. If any provision is held unenforceable, the remaining provisions remain in effect.

Waiver. Failure to enforce a provision is not a waiver of that provision.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a reorganization, merger, or sale of assets.

Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.

Export and sanctions. You represent you are not prohibited from receiving the Service under applicable export control or sanctions laws.

No third-party beneficiaries. Except as expressly stated, these Terms do not create rights for third parties.
